The two main functions of the office of the Clerk of Records are:
- To record and index documents pertaining to real estate in Erie County, Pennsylvania, and
- To act as a collection agent for the Pennsylvania Department of Revenue, all the municipalities and school districts in the Erie area and the County of Erie.
The office handles a vast array of documents, including Deeds, Mortgages, Satisfactions, Powers of Attorney, Leases, Uniform Commercial Code filings and many other types of records. All the records recorded in the office are scanned into our imaging system. All the documents can then be viewed and/or copied by members of the public on one of our several PCs or microfilm reader/printers.
The office collects realty transfer tax on all realty transactions. The tax rate is 2%, half being remitted to the Commonwealth of Pennsylvania and the remaining half is paid to the local municipality and/or school district. Some realty transfers are exempt from transfer tax, ie, transactions between husband and wife, parent and child and between siblings. In addition to collecting Realty Transfer Tax, the office collects recording fees and Pennsylvania Writ Tax on each document filed. Most of those fees are set by Pennsylvania Law.
Although the office has many functions and duties and provides numerous services to the public, it does not depend upon County tax dollars to operate. The office is completely self-sufficient, and in fact generates hundreds of thousands of dollars in revenue each year for the County of Erie.
The Recorder of Deeds office is a very busy place. Between 100 and 400 documents are recorded, receipted, indexed, imaged and verified each day. In addition, the office handles hundreds of inquiries from the public via phone, fax, e-mail or in person. Most of those inquiries are requests for photocopies of documents.
